Gusto is NOT a medical device, nor does it provide medical, dietary, or nutritional advice, diagnosis, or treatment. You should always consult a qualified healthcare provider or registered dietitian before beginning any diet, nutritional plan, or making dietary changes, especially if you have pre-existing health conditions, allergies, or are pregnant.

2. ALLERGEN AND HEALTH RISK DISCLAIMER

Gusto allows you to input certain allergens and dietary preferences. However, Gusto and its owners, developers, and affiliates CANNOT AND DO NOT GUARANTEE that any recipe, meal plan, or AI-generated output is completely free of allergens or safe for your specific dietary needs. Ingredients, food processing methods, cross-contamination, and user input errors can lead to severe allergic reactions or adverse health effects. You are solely and exclusively responsible for reviewing every ingredient and verifying the safety of any food you prepare or consume. Gusto assumes NO LIABILITY whatsoever for allergic reactions, illness, injury, or death resulting from your reliance on the application.

3. FOOD PREPARATION AND KITCHEN SAFETY

You are solely responsible for ensuring that all food is prepared, cooked, and stored safely in accordance with standard local food safety and hygiene guidelines. Gusto is not responsible for foodborne illnesses, injuries sustained during food preparation (e.g., cuts, burns), or any other physical harm resulting from the preparation, cooking, or consumption of recommended recipes.

4. ARTIFICIAL INTELLIGENCE LIMITATIONS

Certain features of Gusto utilize Artificial Intelligence (AI) to generate recipes and meal plans. AI is an automated process and is prone to errors, hallucinations, and illogical outputs. Gusto makes no representations or warranties regarding the accuracy, edibility, or safety of AI-generated recipes. You must apply your own judgment and common sense before executing any AI-generated culinary instructions.

5. ASSUMPTION OF RISK

You expressly acknowledge and agree that your use of Gusto and your consumption of any meals or recipes derived from it is at your sole risk. You assume full responsibility for any health issues, dietary complications, or other injuries that may occur.

6. SUBSCRIPTIONS AND PAYMENTS

All premium features, subscriptions, and financial transactions within Gusto are fully managed, processed, and billed by the respective application stores (Apple App Store or Google Play Store), or via third-party secure payment processors (e.g., RevenueCat, Stripe). Gusto does not directly collect, store, or manage your credit card information. Any issues relating to billing, cancellations, or refunds must be directed to the corresponding app store's customer service.

7. COMPLETE LIMITATION OF LIABILITY, NO FINANCIAL COMPENSATION, AND INDEMNIFICATION

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GUSTO, ITS OWNERS, DEVELOPERS, AFFILIATES, OR PARTNERS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES, PERSONAL INJURY, WRONGFUL DEATH, FINANCIAL LOSSES, LOST PROFITS, OR ANY DAMAGES OR DEMANDS FOR FINANCIAL COMPENSATION WHATSOEVER ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR MISUSE OF THIS APPLICATION, REGARDLESS OF THE CAUSE OF ACTION. YOU EXPLICITLY WAIVE ANY RIGHT TO SEEK FINANCIAL COMPENSATION, REMUNERATION, OR CIVIL DAMAGES FOR ANY REASON.

By using Gusto, you agree to fully indemnify, defend, and hold harmless Gusto, its owners, and its developers from and against any and all claims, demands, liabilities, damages, losses, and expenses (including legal fees) arising from your use of the app, your violation of these Terms, or your infringement of any rights of another.
